Notice at Collection of Personal Information

This Notice at Collection explains what personal information American TESOL Institute ("ATI", "we", "us") collects about you, why we collect it, how long we keep it, and who we share it with. It is provided at or before the point of collection as required by the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), and by other applicable state privacy laws. It supplements, and should be read together with, our Privacy Policy.

1. Personal information we collect

2. Sensitive personal information

We may collect your account log-in credentials. We do not collect government identifiers, precise geolocation, racial or ethnic origin, religious or philosophical beliefs, health information, or information about sex life or sexual orientation.

We do not use or disclose sensitive personal information for any purpose other than providing the services you request, and we do not use it to infer characteristics about you.

3. Where the information comes from

Directly from you — when you fill in a form, enroll, contact us, or use the chatbot or voice assistant.
Automatically from your device — through cookies, pixels, and similar technologies.
From service providers — such as payment processors and analytics providers.
From publicly available sources — for example, professional profiles you ask us to review for job placement.

4. Why we collect it

Provide, maintain, and improve our courses, certificates, and services.
Process enrollments, payments, and refunds, and issue certificates.
Provide job placement assistance where you have requested it.
Communicate with you about your courses, orders, and account.
Personalize content, recommendations, and course selection.
Measure site performance and understand how our content is used.
Advertise our courses and measure the effectiveness of that advertising.
Protect the security and integrity of our site, prevent fraud, and comply with the law.

5. Cookies and tracking technologies

Necessary cookies are used to run the site and cannot be switched off. Analytics and marketing cookies — including third-party tools and the ElevenLabs voice assistant widget — load only after you allow those categories in our cookie banner. You can change your choice at any time using Your Privacy Choices in the footer of any page. If your browser sends a Global Privacy Control (GPC) signal, we honor it as an opt-out of sale and sharing.

6. Who we disclose information to

Service providers and contractors — hosting, payment processing, email delivery, analytics, customer support, and AI or voice assistant providers, all bound by contracts that limit their use of your information.
Advertising and analytics partners — to measure and deliver our advertising.
Professional advisors — accountants, auditors, and lawyers.
Authorities — where we are required to do so by law, or to protect our rights and the safety of others.
A successor — in connection with a merger, acquisition, or sale of assets.

7. Sale and sharing of personal information

We do not sell personal information for money. We may "share" personal information, as that term is defined by the CPRA, with advertising partners so that we can show our courses to people who may be interested in them. You can opt out of that sharing at any time by using Your Privacy Choices, or by sending a Global Privacy Control signal from your browser.

8. How long we keep it

We keep personal information only as long as we need it for the purposes described above, and then delete or de-identify it. Typical periods are:

Enrollment and course records — 7 years after your last course activity, so we can verify certificates and meet tax and record-keeping obligations.
Job placement materials — 3 years after your last interaction with our placement team.
Marketing contact data — until you unsubscribe, or after 2 years of inactivity.
Support, chat, and voice assistant transcripts — 24 months.
Server and security logs — 12 months.

9. Your privacy rights

If you are a California resident, you have the right to:

Know and access the categories and specific pieces of personal information we have collected about you, and how we use and disclose it.
Delete personal information we have collected from you, subject to certain legal exceptions.
Correct inaccurate personal information we hold about you.
Opt out of the sale or sharing of your personal information.
Limit the use and disclosure of sensitive personal information.
Not be discriminated against for exercising any of these rights.

Residents of other states with comprehensive privacy laws — including Colorado, Connecticut, Virginia, Utah, Texas, Oregon, and Montana — have similar rights, including the right to appeal a decision we make about a request. To appeal, reply to our response and tell us you are appealing.

10. How to exercise your rights

We will verify your request, usually by matching your email address and enrollment details, and we will respond within 45 days. If we need more time, we will tell you why. An authorized agent may submit a request on your behalf with your written permission.

11. Children's privacy

Our courses and this site are intended for adults. We do not knowingly collect personal information from children under 13, and we do not knowingly sell or share the personal information of consumers under 16. If you believe a child has provided us with personal information, please contact us and we will delete it.

12. Changes to this notice

We may update this Notice from time to time. When we do, we will change the effective date at the top of this page, and we will post any material change here.
